Food safety compliance is the most common reason spice shipments get delayed, detained or rejected at destination. The rules are not secret โ€” but they are strict, and they differ between markets. Here is what importing spices into the EU and USA really requires in 2026.

EU requirements

  • Pesticide residues: EU MRLs (Regulation 396/2005) are among the world\'s strictest. Spices are a high-risk category under increased official control (Regulation 2023/1110 lists nutmeg, ginger, turmeric, chilli and paprika among products requiring mandatory lab testing at entry).
  • Aflatoxins: B1 max 5 ยตg/kg, total max 10 ยตg/kg for most spices; chilli, paprika, nutmeg and turmeric carry increased frequency checks.
  • Ochratoxin A: max 15 ยตg/kg for most spices; 20 ยตg/kg for capsicum.
  • Salmonella: must be absent in 25 g samples for dried spices per EU microbiological criteria.
  • EU health certificate: consignments of spices under increased control must enter with a completed health certificate from the exporting country\'s competent authority (for India: FSSAI) and results of official sampling.

US requirements

  • FSMA: importers must be FDA-registered Foreign Supplier Verification Program (FSVP) importers and verify their foreign suppliers\' compliance.
  • Adulteration: FDA prohibits food containing any added sulphites not declared; undeclared sulphites are a leading spice detention cause.
  • Filth & decomposition: FDA Defect Action Levels apply to spices (e.g. insect filth) โ€” cleaning and colour sorting matter.
  • Prior notice: every food shipment requires FDA Prior Notice before arrival.
  • Label: country of origin marking, ingredient statement and nutrition labelling for retail packs.

The certificate stack your shipment should carry

  1. Certificate of Analysis (COA) โ€” every parameter of your contract.
  2. Phytosanitary certificate (for whole/raw products).
  3. Health certificate (EU increased-control products).
  4. Certificate of origin.
  5. FSSAI / APEDA registration copies.
  6. Sterilisation or treatment certificates (if applied).
  7. Insurance certificate (for CIF).
